Lawful Selling Of Gun Caught On Tape
    Saturday, November 16, 2002
    John McCroskey, johnhome98532@yahoo.com

A few days ago, my undersheriff received a call from a television
station … they wanted me to comment on some video taken at a gun show
recently held here. Apparently, while under cover, they videotaped
the sale of a rifle by a private person, to the undercover reporter.
It sounded like they wanted me to watch the video, and then wring my
hands that something like this could happen. Hmm. It sounded
    interesting.
At the appointed time, they arrived, all the way from Seattle. I
guess it isn't news that one of the largest gun shows in the state is
held in King County. As they set the equipment up, the reporter began
by looking at me with a wrinkled, almost pained look, and
said "Sheriff, (that's me) we came down and secretly videotaped a gun
purchase between our reporter and a private person at the gun show in
Centralia … are you concerned about that?"
"Let me be sure I understand what we have here," I replied. "You have
a video, of a lawful transaction, by law-abiding citizens, and wonder
    if that concerns me?"
    Nope.
"But Sheriff, he bought the rifle in five minutes! He didn't have to
fill out any paperwork! Surely that is a concern."
Once again, looking very thoughtful, I said, it was not. The lawful
acts by citizens should not be an issue with the police. We don't
make the laws, we deal with crime.

By now the tape is rolling, and he has re-asked the question, and I
have generally restated the answer. I used an analogy for him. If a
car is speeding along a road, at 50 mph and the posted speed is 50
mph, it may be troubling, and yes an accident could occur, but it
wasn't a crime I could do anything about.
He went on. "Sheriff, there is pending legislation which would close
the gun show loophole. Would you support this kind of legislation?"
I told him I have not seen the legislation, but doubt it would be of
any real value. The fact is, there are many laws, state and federal
on the books but they haven't been enforced for years. In fact, they
are looking for ways to reduce sentences which will increase crime
But I don't believe restricting law-abiding citizens' ownership of
firearms does anything but make them easier victims. If it was as
easy as passing laws, then there would be no crime. But it isn't. Law-
abiding people are law-abiding because they follow the law.
Lawbreakers don't care what the law is, and will find a way to get
guns and gun shows are only a tiny piece of all this. If tomorrow
there were no more gun shows, the reduction in crime would be so
insignificant it wouldn't register. But put crooks who use guns in
jail for a long time, and see what happens. It works and works every
    time it is tried.
It was pretty clear I wasn't behaving the way he wanted. We talked
about crime statistics and how they can be used to make a point on
either side of the argument. ( I forgot to ask about the gun shop in
Tacoma that was found wanting more than a year ago … and nothing was
done.) In the end, he asked me if there was anything else I'd like to
    add or was concerned about?
"Yes" I said "there was this one thing I was deeply troubled by …
something so concerning to me it made me shake." He leaned forward
and asked "what was that?" I said "Now, there is a liberal reporter
    with a gun."

The only thing I dont care for with the current laws (in Indiana at least), If a Person buys a weapon (lets say a handgun) from another person that originally bought the handgun from a dealer. The handgun is in the original buys name. There is NO paper work to fill out for the transfer of a firearm from person to person except for a receipt of sale. SO, if you get pulled over they run the numbers on the handgun and find it's registared in someone elses name its a fellony, UNLESS you have the receipt for proof of purchase. This is the only bad thing I have found in the system. I really like gun shows and most of the sellers are dealers, dealers are required by law to run background checks on anyone buying a firearm, but person to person sales are not required to do background checks and there is no LEGAL paper work to transfer a weapon from person to person. /forums/images/graemlins/deal.gif
    Thats my two cents...
    TREE HUGGER LIBERALS DO SUCK!

Anyone heard about the PETA group crashing the victory secert show the other night because one of the models advertises FUR (you know because shes a model, its not like they have actually ATE anything for past ten years). The radio station here locally is threating PETA that the next time they do something like this they are going to WACK a hampster with a snow shovel /forums/images/graemlins/ignore.gif

Here in michigan one cant legally buy/sell a handgun with out acquiring a purchase permit from the police, long guns are another matter, legal for private party sale. Interesting that you can do that in indiana.

I dont have a problem with gun show purchases by private parties, but i do have a problem with all the mall ninjas, suburban commandos, and people with a comlete lack of safety and common sense at gun shows. I have been looking at the wrong end of gun barrels too many times at shows, I just refuse to go to them now too many morons around.

I like one bumper sticker i saw, my guns have killed less people than senator kennedys car. he's a liberal right?

Yep, in Indiana you dont even need a gun permit to own or operate, you just can't carry (I guess its actually a carry permit). My friend bought a gun from one of his friends, both adults in good legal standing minus a few speeding tickets, they can sell a gun to the other without telling anyone. That same guy GAVE my friend a small .32 cal pistol as a wedding gift, but they made up a receipt saying he bought it for $1, just to have proof of purchase.
I contemplated buying a PPK/S and a HK USP compact from an individual (my close friend before he moved to china for school). I got doing some checking and contacted my sherrif's station, the same one that I got my permit from, and asked about doing paper work to legally registar the pistols into my name and the dispatch almost laughed at me like I was an idoit and said theres no paperwork for individual sales. SO I asked, if I get pulled over with one and the numbers are ran and it comes up in this name and that person is not able to be contacted how is that handled and she said it would be fround upon and I could be arrested without proof of purchase!? WHAT!? Does that make sense?
The ONLY way to leagally get a gun in your name is to take it to a dealer and have them do the dealers transfer paperwork and they charge $25 per weapon reguardless of handgun, rifle, or shotgun.
Did you know cross bows are illegal in Indiana? You can have one at home but dont get in trouble with it. You can buy a high power rifle and carry it in your truck but dont get pulled over with a crossbow. I dont think you have to have a carry permit for a rifle or shotgun, the permit just says handgun (and for some of you will get a kick out of this, its NOT a conceled carry permit, its a carry permit. You can have it in plain full view in public. You may be asked to leave stores and the police can have you cover it but its not a concealed weapons permit.) Your coverage on that ends on state and federal grounds as that is a federally restricted zone and has been for a long time.
The leagal system is insane. Indiana taxes are going up in December also from 5% to 6% I think we are the last state at 5%. /forums/images/graemlins/thumb.gif
