Legallity of an ASP?

    So the other night I geuss I pissed someone off while I was driving and they began to follow me while the girl friend was with me. Now mind you, im not that big only 175 lbs and 6'3" tall so im not very intimidating. So back to the story i eventually drove around enough and got the ass hole to quit following me, but I want to get an ASP to keep with me in my truck in case someone wants to try and get violent with me but im worried if I get pulled over by a LEO I will get popped and all sorts of bad crap go on seeing that im only 19. I read online that they are illegal in the lovely state of CA unless you take a class or something. So im looking for some insight from everyone else.

    Yeah I think im probably gonna go with a mag light, but I still want some opinions from some of the LEO's and former LEO's on the board.

    For those uncertain just what an "asp" is, it is the brand name of an expandable metal baton.

    An asp in the state of California is considered an impact weapon and unless you are a peace officer as defined by CPC section 830 or a certified uniformed security guard, possession constitutes a felony weapons charge under CPC section 12020 (a)(1)....Buy a flashlight.... :)

    depending on its use.... a felony in california

    BUY GAS instead.... works well... and if your justified in using it... not a problem....
    and after you spray the guy and drive away he wont be reading any license plates real soon

    My spare axleshafts are all right behind my seat, and attatched to the floor is both a big mag light and a fire extinguisher in front of the center console. I have my choise of vehicle defense :D That short side inner sure would hurt.

    along with the flashlight i also have the club taken apart there is a section for each hand :D :D

    I have a couple of good friends in the Sheriff and Police departments here and what I was told was that while the ASP itself is not illegal to carry here the ramifications of using it can be severe. A civilian with no formal training that uses one would more than likely be charged with assault with a deadly weapon in addition to exposing themselves to a civil suit from the beatee, while a LEO or trained idividual would not as they would be deemed to have enough training to not inflict deadly damage.

    So, hopefully I won't have to use the 21" that's in my truck :grin:

    Besides, I'm applying for my CCW this summer anyway, much better deterrent.

    True. To possess an ASP unconcealed (without CCW) is not a crime in and of itself (in Colorado). If you use it, you better be justified in deadly force as most people are not trained in proper strikes. If used against the head or joints you will cause very serious bodily injury or death.

    I am sure the great state of California's laws are quite different with the possession.

    I definately agree with the OC spray for self-defense. You have a much lower level of force to explain.

    jesus ive never thought of it like that, i used to keep mine in my truck, when it was getting a lot of use (my truck not asp) ;) i had gotten it out and put it in my pocket in more than a few times, idiot, i always knew it was illeagel but a felony geez!, i havent used it in a while and i dont think, its ever coming with me again, thanks for the eye opener

    when I said depending on its use I meant if it was used against another person who was commiting a felony... it would still be 245(a) 1 pc ADW... but may be justifiable and therefor not charged

    The magic words policemen have to live by...... they work for citizens too
    "reasonable, necessary, and fully justified by the circumstances"

    Now... its against the law for the old grape to shoot his drinking partner....but if the drinking partner was beating the victim who feared he was about to be killed.... well... we might book him... but he would probably just get a ride to the station...talk to homocide... and the thing would go to a D.A. reject.... and he would never spend a night in jail
    (this is a common ghetto crime)

    but... as you said carrying an ASP in california... is a felony for a citizen....
    and a really good reason to get you and your vehicle searched.... and a whole lot of hassle from a black and white

    thanks for clearing this up.... we dont want anyone getting arrested
