My bad experience w/ "Performance Gear"

    My bad experience w/ \"Performance Gear\"

    Company name: Performance Gear, Lumberton MS.
    This company advertises in major 4x4 magazines, selling transmissions & parts.

    I bought a 5 speed and spare parts for $2300 on my VISA. The trans arrived water damaged. This company, after repeated written and verbal requestes HAS NOT to date, provided me with any: bill of sale, invoice, VISA receipt, packing list, written warranty (they've had 4 months). These papers were never provided. Trucking company refused my damage claim, rightfully, I now believe.

    Use caution if you consider buying anything from this company.
    If anyone has advice, please post or email me. Thanks.

    If I were you the next person I would talk to is a lawyer. Then he could tell you exactly what your options are legally.

    I would also call Visa and get a statement from them showing that you paid $2300.00 for the transmission etc.

    Some Visa's etc have a buyer protection program with the card. Did yours?

    Just some thoughts.

    Steve you need to start litigation against that company ASAP, consult an attorney, all ancillary costs should be included in your lawsuit, such as lost time from work because you couldn't get there. etc. you have only that option if you want a chance at your money back.

    Steve, write a letter to your credit card issuer and explain all the facts. Request a charge-back to Performance Gear and full credit to your account. Time is of the essence. Good Luck. Bill

    You should of contacted the credit card company they would not pay the bill until it was all straightend out for you and they would do all the work...

    Steve please let us know whats going on. That amount of money you spent is a lot where I'm from. And If you don't get satisfaction from that company I'll spread the word. I'm in a couple of car clubs (GTO and Camaro) I'll tell those folks to steer clear!!!

    Follow up:
    I sent the co. a certified letter asking for a receipt for the merchandise, and a resolution to the
    damage. To date, I have not received a receipt, warranty or packing list. I elected
    not to return the one phone msg I received from them, because I wanted
    (and deserve) everything in writing.

    Before I sent the certified letter, the man said on the phone "we do not provide receipts"
    Saying that prompted me to send the letter asking for one.

    I have almost decided it makes more sense to take my losses,
    and disassemble and clean the mud out of the *new* tranny myself.
    I am not sure if I got everything in the kit because they won't send me
    a packing list.

    I would advise against buying anything from this company.
