N E one help me weasel out of a

    Hey y'all, got my first "speeding" ticket ever tonight. I use quotations because I think I got cheated. This happened in Nebraska on a four lane highway (Hwy 20), with a speed limit of 60. I was driving my dads Jimmy and it has 3.42 gears (stock), 33" tires, and stock speedo gears. When I'm on this stretch of highway I do around 55-60 on the speedo.

    I'm moving along and I see the sheriff going the opposite direction, look down and see my usual 55-60 range on the speedo, and I think nothing of it. A few minutes later I look up and see the flashing lights. We stop and he's walking up to the truck and crouches down and looks at the license tags. They expired in December, but as well all know, they have 30 days lee-way (We do have the new tags, just have to put them on). He comes up and asks for all the paper work and then asks how old am I (19)? Then he says he clocked my doing 10 over and talks a little and mentions I need new plate tags twice.

    We get in the car and he shows me "69" on his radar gun. I tell him that I didn't think I was doing that much. I explained to him about the tire size and the effect on readings and I would be doing around 61-66. He told me I should have my speedometer recalibrated. He writes up a $10 ticket + $23 court fees and tells me about this class I can take to get out of it. The class is eight hours, which is totally overdone for "9" over. I was all very nice about and figured, I'd get a warning, but nope. His name tag said he was serving since "2000".

    I feel I was getting picked on because its big truck with 4" lift and 33"s. Why did he pull across the median for me? Why should he care about my age? Why do I need to know three times that my tags will expire in 12 days? Why couldn't I get a warning because I have a perfectly clean record that is going to be messed up with this. Insurance is all ready sky high with my good students discounts, etc. Is "9" (according to him) over really that big of a deal to not give a warning?

    I was just figuring protesting saying I was doing my best guess. I'll have a bunch of calculations drawn up, you know, the 336xspeed...etc. I was getting picked on by the new guy out trying to get the world by the tail (I know all about that because my dad has been a cop for 29 years and is always laughing at the new guys pulling everyone and anyone over.) Its pretty easy to tell when you're flying and I still had cars a reasonable distance behind me. I didn't pass anyone, just people behind mee that weren't left in my "69" mile an hour dust.

    Yes I know, much to do about nothing. This just really bothers me because I'm supposed to be the good guy and don't need this and the insurance B.S. Do I have a chance of at least getting a warning?

    [​IMG] Cited by a deputy, I would suck it up and drive on. That's pretty bad. Well, the first mistake was trying to 'xplain to him about gears and tires and wind and the rotation of the earth. Have you ever rode with your father and does he have radar? Great training and a way to get the older cops to do something. [​IMG] Shoot for a trial and see if the deputy shows up and bring up the calibration issue. Can't do any thing worse than lose.

    Haha, yup, got roped by the new guy. My dad's a desk jockey at the moment, he might get to go back to the streets in a year or so, he gets rotated all over. Before this he was on vice and got to do drug and try to pick up prostitutes. I used to get a kick outta that. When people asked what my dad does, I'd say he picks up prostitutes for a living, haha.

    All I'm asking for is a warning. According their equipment I was breaking the law and I can't change that. I made efforts to determine my correct speed and I believed I was within the limit and will know better next time. Oooo, dad just came home, lets see what he says.

    When I get yanked, I just go with the flow. Answer the questions, give them everything, license, reg, insurance. They say that a lot of times the cop already has their mind made up before they talk to if they are gonna cite or not. I've done the same thing on every stop, and I've been yanked 8 times in 13 years and received 4 cites.

    just a few comments--

    Your lucky you were not in Vermont,, here the last day of the month on your sticker- is the last day your plate is good- that alone "unregistered vehicle" is 200 bucks and 3 points on your license.
    Had you been dumb enough to tell the cop that your speedo doesnt work- is off becuase of your tires or what ever- would have been "defective equipement" thats 135 and 2 points--

    Then he could have asked you "when did you put those tires and lift etc.. in/on?" and when you replied, he would have gone to your inspection sticker- and seen when that was issued, here its every year- had your sticker been issued, AFTER the changes- he "could" go after the inspection place, for inspecting a vehicle with faulty components "that being your speedo"..of course this is if the guy is a prick...most here are...Next time you get pulled over and your speedo doesn't "add up" SHUT UP... you could have had it A LOT worse than you did...35 bucks is a LOT cheaper than the $500 if could have cost you here.
    As for him being "new" I don't think it had anything to do with it, nor the fact that your truck was lifted etc..

    because you were doing 69 in a 60 and thats his job.

    sorry to sound so "cold" but you were speeding..and your plates had expired...what did you expect him to do?
    oh I know a warning- those are nice, when you get one, but you probably would have had you not tried to explain to him about your gears, etc.. just by saying "gee sir, I do appologize, I really didn't know I was going that fast." and left it at that.

    Seems like around here in Michigan they give you a 'fixit' ticket and you just have to show them proof you somehow fixed the speedometer. [​IMG] Much better than on either coast. I'm convinced both coasts of the US are actually socialist states... Completely seperate of the former US. Do you have to hold your right arm all the way out when you see a public official or police officer or the simple vertical right hand salute works ok?

    The first time I ever got even pulled over the SOB wrote me a ticket, it was also for exceeding the speed, and I didn't realize the speedometer wasn't calibrated right. So I didn't know of that argument. I was very nice with the guy, etc... Answered all the questions, wasn't a smartass or anything.

    "Do you know why I pulled you over?" *thinking-- because you felt like being an a--hole tonight and wanted to harass someone who wasn't doing anything wrong* actually said -- "Well since my speedometer was dead on at 55mph, I was in my lane, there weren't any stopsigns around I could have ran, I'm not sure." Turns out it was a 45mph zone, that I didn't know about. That route was a different one than I usually take due to me trying a detour around the normal route due to construction on it. I mean the guy could have cut me a little slack on that, since I wasn't that used to the road there. [​IMG]

    I don't get it though, I mean first thing you're ever stopped for unless they're a complete a--hole they should cut a little slack anyhow... [​IMG]

    On the other hand, I do have respect for the police, the ones who have better things to do than to harass someone for a few mph over, especially after they explain it's not intentional. And especially if they're being decent, not beligerant, etc about it.

    The best thing to do, immediately when you get nabbed, is to offer the cop money to let you go. Surefire way to make him forget the original violation...

    Seriously, though. Wait til court for the excuses... Regardless of what he wrote, you were doing more than the limit, but under 10 above the limit (here in NY it goes in steps of 10mph over the limit). Fighting the ticket will be difficult because you actually saw his radar reading. As for "why didn't he let me off"... What you do at the scene will really influence whether or not you get a ticket. I have seen what all my variations in attitude can produce, negative resulting in a ticket!!


    BTW, in NY (suffolk at least), that ticket would cost you minimum $50, probably $75, and would likely jack your insurance 10%. No class or anything is available to eliminate a ticket, either.

    Well the tags should have a processing date on the paper work. Take that to court. Show the judge and tell him it's your dads truck and you were not aware the plate had not been updated but it was renewed and can be proven by the dated state paperwork. That will probably get dropped if the dates are good.
    Go get the Speedo checked. They should write what the speedo is reading at actual speed. Tell the judge you had the speedo checked give him the paper and pray the cop doesn't remember your little discussion about knowing how the tire size threw off the reading. Hoepfully it will get dropped. Fact of the matter is you knew it was off and if the point get's pressed you are quilty. As for the class. ehhhh if you get the stuff dropped it's not worth the time. Can you make more money at your job in 8 hours than the fines are? Is it enough to effect your insurance rates? Sort of a gamble on your part. If you had not opend you big mouth about know the tires effected the speedo and just pleaded stupidity and pointed out it was your dads truck and you were unaware of the speedo being off I would say you had about a 90% chance of getting out of most of it. Rookie cop and your conversation...Hard to say. Seasoned cop would have let you of with a warning and waited for the guy a few miles down the road going 15 over for the bigger fines. If your tag had been ok you proably would have been let go after he checked it. As for him crossing the median....Hay he may have been where he normaly turns around and then he clocked you. Did he offer to verify the calibration of the unit? I know here in GA they have to offer to close a loophole. Typicly the verify calibration before each shift and if they offer they know it's good. Problem is it's a 19 year olds word against a Cops. Sorry but your age does profile you.
    The error in your figuring the calibration of the spedo is a couple of things. Speedo's are not always acurate from the factory, Tires are not the exact size listed on the side.

    OK OK, I wasn't fast enough, you see if I was driving my short box that I'm building the motor for right now, I'm sure that 340 hp would have not allowed him to get close enough. Yeah I gotta slow down, but honest to God to thought I was alright.

    As for the county that happened, there police force isn't exactly a crack unit. For example they had a shooting where they shot this guy 11 times and still didnt kill him, haha. The poor bugger is in jail now. I'm just takin the stupid class and thank God I don't live over there. I'll let y'all know how boring the class is. This had to happen for a reason, because things are getting very strange latetly. Like I locked my keys in the Jimmy on Thursday and I got a ride home from this girl I like [​IMG] Later.

    heres the solution. move to alabama. i was doing 80 in a 50 zone way out in the sticks (hey it was 2 a.m. the only one i would kill would be me). the cop flashed his lights as i went buy to tell me to slow down so i did. i guess he didnt feal like getting out of his car.
    anyway alot of radar devices are wired into the police cars speedo to subtract thier speed from the speed of a vehicle coming at them. in court ask when the last time his speedo had been calibrated. that one ussually works great. also check your ticket for ANY mistakes. if he spelled your name wrong, wrote down the wrong vehicle color, or anything like that, that will ussually get the ticket thrown out.
