Running a Red Light ticket...

    Okay, say you get a ticket in the mail saying you ran a red light and they have the pictures of the van, etc. You get it because the vehicle is in your name.

    BUT, the picture is not you, someone else was driving the vehicle, someone other than anyone in your family, etc.

    What are the chances of getting it thrown out?

    How far do they persue it to find out who the drives actually is?

    Drivers Who Block Their Face Are Never Cited
    A driver who obscures his face while transiting an intersection is also not subject to automated enforcement. Without a clear photograph of the driver, no citation can be issued The California Vehicle Code (CVC Section 210) requires a "clear photograph of a vehicle's license plate and the driver of the vehicle" for an automated enforcement citation to be issued.
    Again, a dishonest driver can totally avoid automated enforcement by placing his hand over his face or by flipping down his visor while running a red light at an intersection with automated enforcement. Truly dangerous driver can more easily run lights under these circumstances, knowing that they are immune to enforcement.

    Are special laws needed to allow localities to use red light cameras to cite violators? In order for localities to use the cameras for law enforcement purposes, laws must authorize enforcement agencies to cite red light violators by mail. The legislation also must make the vehicle owner responsible for the ticket, establishing a presumption that the registered owner is the vehicle driver at the time of the offense. Red light cameras are currently permitted in 12 states -- Arizona, California, Colorado, Delaware, Hawaii, Illinois, Maryland, New York, North Carolina, Oregon, Virginia, and Washington -- and the District of Columbia. Violations photographed by red light cameras are most commonly treated in two ways -- as traffic violations or as the equivalent of parking tickets, depending on state law. If, as in New York, red light camera violations are treated like parking citations, the law can make registered vehicle owners responsible without regard to who is driving at the time of the offense. Virginia makes red light camera violations a civil offense like New York, but unlike New York, the state allows registered owners to avoid citations by filing affidavits swearing they weren't driving when the violations occurred. back to questions

    The thing is, the registered owner of the vehicle was NOT driving the vehicle. Its clear as day, the registered owner is NOT the guy in the picture. They ask for a place on the forum they send you, that if the driver of the vehicle is not you (registered owner), who is it?

    If you own the vehicle than you have the right to pay the fine and it's on your license or you can have the person that ran the light pay for the fine and it goes on their license.....

    Another reason NOT to run a front license plate.


    I'll take my chances with a "fix-it ticket" than a moving violation for red light running. :deal:

    Whats up big guy. long time no see. Finally got the blazer up and running. Had to have everything completely rebuilt but oh well. at least they work. LOL


    p.s. say you don't remember who was driving. that you were knocked for a loop and someone helped you get home.(good semaritan) How ever you spell it. LOL

    im still waiting to get mine in the mail... i saw the cameras, no flash. dunno if they took the pic or not. im BAD about turning left on a red arrow some times.... its intentional and safe.... just not legal.

    I had a friend get one for a van she just sold. They threw it out when they realized the person in the van was black and she was white.
