    My sister and her best friend were involved in an accident. Some car stopped short at a yellow light that just turned. The car in front of my sister stopped just short of hitting that first car. My sister BARELY missed hitting the second car. Her friend was behind her and just ended up rearending her. His car is ****ed up pretty good. What it is worth, it is likely totaled but he will likely be able to fix it. My sisters bumper is scratched and the paint is spiderwebbed, THAT IS IT. Now the car was just recently fulled painted. Paint isn't perfect at this point, the paintjob was very good for what it cost but there are already scratches in it and such. She is 16, things never end up perfect when you are 16 driving a nice car. At this point, she is telling him he has to pay to repaint the bumper(she JUST noticed the spiderwebbing when this happened 2 days ago). He says he won't he can't afford to do that and repair his car and such. He told her if she wants he will give her another bumper with nothing wrong with it(which Id on't think there is anything wrong with hers either and neither does he), but she wants him to pay for the repaint. She looks at it as, "rear end is his fault no matter what". I look at it as, she is damn lucky she didn't rear end the other car or else that would be her fault and her ar would be ****ed. The fact that she didn't is just luck. When she called me afterwards she made it sound like she had to swerve to avoid hitting it, so her friend was left with no where to go.

    If it were me and my best friend, I'd tell him to forget about it, worry about your stuff, I'll take care of mine if I care that much. I can understand wanting him to take care of it I guess, but me I wouldn't do that.

    Opinions?

    Her friend has no insurance or does he not want to make a claim? If he has insurance and is making claim on his car, then he should include hers as well... :dunno:

    They're 16, what are they doing with nice cars?

    I drove cars that I couldn't care less about until a year after high school... I still probably wouldn't have a cow if some paint on my Jeep's bumper got messed up...

    I say let them figure out the driving lesson embedded in all this and just worry about their own crap if their friendship is worth anything to each other... If the one was trying to avoid a worse accident and the other was so close/paying so little attention that an accident occurred, it sounds like forgetting about it is the way to go...

    Agree with this one. If insurance is involved, he SHOULD pay for it....and if it isn't, remove the bumper cover on her car, get it painted somewhere for her for like $50 and get him to pay it in installments or something.

    hes 19 she is 16.

    oh and when she got the car hers was messed up, he did most of the work on it and was very soon, GIVING her a Cobra intake and roller rockers for hers. (both Mustangs).

    It sounds like everyone was following WAY to close. They are all at fault.

    Oh yeah... Tell em to get some friggin insurance!!! Enough people I know have been screwed by people with no insurance who don't pay up, I'd hate to have it happen to me...

    I'd let it slide, but then again I am lazy and apathetic when it comes to cosmetics on my trucks (which is why I havent washed my DD in around 7 months). The guy sounds cool enough to let it slide, but tell his dumbass to get insurance.

    he is at fault and should pay if she cares that much. thats how i see it. now would i have it fixed? i doubt it but it would depend on what kind of car it is. i agree they were all following too close, but all but one didnt hit, so i stand that he is at fault.

    Speaking from a strictly legal standpoint using Ca. as the basis, it is his fault and he is liable. She is not at fault at all. The law in most states says that you must give enough room in front of you to stop even if the vehicle in front stops suddenly. The fact that nobody in front of her, along with herself, did not hit anything means that the only accident was her being rear ended. The only time the person who got rear ended bears any liability or fault is if they arbitrarily slam on the brake for no reason. Even then, the law again states that the person following should be at a distance that they can still stop in time. If this was a stranger who hit her, my response would be to tell that person to paint the bumper, or the alternative is a called in accident report to the police, and a report to the insurance company. I guarantee the insurance company would make the person doing the rear ending liable. Since they are friends, that throws a monkey wrench into it. She needs to decide how far she pushes it for the paint and whether or not it will impact their friendship. Sometimes there is a bigger picture.

    well, with the case of the Cobra intake, and roller rockers, that's a fair trade.

    call it good at that, tell his dumb ass to get insurance, and be done with it.

    I coould see making him pay if there was some real damage such as crushed bumper, taillights etc. but for spiderweb in paint, she can get that at a parking lot. If there that good of friends she should forget about it and take the amount of damage in trade of something.

    Dumbass should have insurance

    He hit her from behind, he's at fault plain and simple. If he won't pay, she needs too take him to court. If he was a real friend, and didn't have the money, he should try too work out a payment plan. But in all honesty, if he doesn't have insurence, he shouldn't be driing !!!!!!

    Did he do all this work for free? If I worked on some girl's car for free and then she insists that I pay for the bumper/paint, I would paint it and then tell her to f*ck off.

    X2! Why is a 16 yr old driving without insurance?? Another reason the rest of us that do pay for insurance pay higher rates. If he is a "freind," he will fix it.
