Actually, I think you are totally absolved of blame, then. I don't know exactly how the laws are written in TN, but in CA, the other driver would be at fault. If you have the right of way, you have it, the fact that you swerved to avoid a hazard in the road isn't a factor. He has to yield to you, and shouldn't have been so close that you could hit. Usually, there are no lanes in an intersection, so you can't really use that...you often hear that you can't change lanes in an intersection...it's not because it's illegal, it's because there aren't any lanes. Since left turns are lowest on the right-of-way list, they are almost always at fault.

The reason your insurance can't get ahold of him is because without his statement, they can't determine fault. He has one of those crappy insurance companies that won't tell him to cooperate, since they know if he does, they will have to pay the claim. The game is, they claim they can't get a statement from him, so they can't determine what happened. Funny how if they wanted to get the policy paid, they sure could get ahold of him, but for a statement, they call a couple of times and give up....Often times, if you had full coverage, your insurance company will end up repairing your car and then having to sue him in order to get a statement....and for this kind of damage, it's just not cost effective to do that, so they end up eating it, which is why rates are so high.
Your adjuster has dealt with this before, hopefully the two adjusters can agree on fault based on what the circumstances are and the damage to the vehicles says. I take it there were no witnesses who may have stopped? Possibly video from a gas station or business on the side of the road? Cell phone pics of the skid marks if there were any? Photos of the vehicles prior to them being moved out of the roadway? It's a loophole that should be closed.

the other driver happened to be driving a company car (Enterprise rental agency) and he provided a “proof of self insurance” document photo he said his boss sent him. I’m hoping they can track it down through that document. I felt kinda bad for the guy, an older gentleman who didn’t seem to know how to use his smart phone to text me the document, but if this is how they want to have it go down, I’m starting to feel not as nice about it.
 
Had a girl rear end me trying to change lanes at a stop and drove off. Got a picture of her license plate and the cops gave me her insurance and contact info. Insurance and police couldn’t get her to pick up the phone so they couldn’t deem fault and it was now up to me to repair my car. Complete crap.

sounds like what’s going to happen in my case. But I’m pretty sure I have uninsured motorist coverage so I might try that. Someone rear ended me a few years back and I got it repaired that way.

Yeah, I don't know what company he's with, but they may be telling this guy not to talk to anyone about the accident. Good thing is, no matter what was provided, the ultimate responsibility for insuring that car will lie with Enterprise. If you have a decent insurance company, they will be able to get someone to give a statement. It's in their best interest, if they can't put the other driver at fault, that means they will have to pay out a liability claim. Those adjusters are overworked so my advice is to keep your claim on their mind by calling them enough to let them know you care and you're not going away so they keep working on it and it doesn't get buried....be nice, they're on your side, but be persistent. I'm sure you will also want this going on your driving record as a not at fault collision rather than an unknown. If you guys have a mandatory reporting requirement there.

As for the other cases, yes, it's becoming a well known loophole. Sad thing is some of the cheaper, fly by night insurance companies are telling their insured drivers not to talk to anyone regarding the crash, and they won't be held financially responsible. No one will return a call, and the crash is just your story, meaning they won't pay. And unless you can prove the other driver was uninsured, you can't make the claim via uninsured motorist coverage. Since you know his name, your insurance company can run it in a database and see if he has a policy. Unfortunately, they have already gotten around this one by being self-insured. The one good thing is that if you're really pissed and this doesn't work out, you can subpoena the company that has filed the certificate of self-insurance to small claims court and have the judge order them to pay for your car. May not be worth the effort, but I know sometimes people get pissed and take this personally.

I'll be watching this to see what develops next, both with the transition to rally cross racer and the insurance mess. I may be able to help out with the insurance thing if it doesn't work out. Good luck with the rally car...with a little trimming you could probably squeeze some 31s in there!

I test drive another one today with a used replacement engine in it. Interior wasn’t as nice as mine, but body was in better shape. He wanted a little too much for it though. I’m really anxious to poke around mine a bit more to see how bad it really is but i don’t want to mess up a damage estimate if they need to do one.
Nah, enjoy it too much haha. Seems like $5-6k will still get you a decent one?
 
Didn’t plan for this to become a repair thread, but made some progress on repairs. I had to shim the fender about 1/8” because the mount was tweaked just enough to make the hood gap objectionable.

found a fender from a local wrecking yard $140

My windshield washer bottle was squished just short of leaking but will work without replacing

the little white plastic nut isn’t quite grabbing the sheet metal frame that was squished. May try to squeeze another 1/8” of movement out of it so it engages with the fender.

And test fit of the old bumper cover. The snaps in it were ripped off so I have a replacement on order. Depending on how I feel, I may paint it along with rhe hood after doing the finish work on the damaged portion.6585CB47-DA73-4827-A050-3A59F16D5888.jpeg
