Dealer License - Safety Minimums?

Ok.

For some reason, i'm under the impression that it is illegal for a California registered car dealer to sell a vehicle that doesnt' meet certain saftey minimums.

IIRC, this is a minimum brake pad life, and tire tread depth.

Can anyone confirm? Where can i find this info.

Drove my "new" suburban 350 miles home from LA today, to reach Pleasanton and have a horrible grinding start in the front.

Inner pad is totally gone, outer pad conveniently has the "brake wear indicator" bent away from the rotor....

Was it a certified used car? Did it have one of those "Safety Checked" stickers on the windshield? If the answer is no looks like you may have got screwed. If nothing else I would call the dealer and see what they say.

I opted out of the "return policy" thing, because its only good for 250 miles, and that wouldn't' have even gotten me home.

Spoke with the guy briefly, he said he'll cover the cost of getting it done, but he wants to know what the estimate is before it is completed.

I'm going to take it to the local dealer, and have them give us an estimate, plus have them do a "minimum safety inspection".

It at least needs front pads / rotors.

We'll see where we end up.

What a great way to suck all the fun out of buying a new rig....

I would try to make the quote as reasonable as possible. If it looks excessive he may tell you he will only fix it if you bring it back to him...

This type of response would be risky with a dealers license i would think.

My understanding is they are REQUIRED to do an inspection, which he clearly didn't do. If he wants to play hardball, I'll go to DMV, or whoever regulates dealers licenses....

He seems like he'll cooperate, but his first idea was to send me pads. Definitely not getting involved in doing it myself...although I am more than capable.
 
Keep us posted on how this works out. Oh and where are the pic of the rest of the rig......:whistle:
 
I really dig the bumpers.... the front with the built in driving lights and the cutout for added air flow to the radiator.:thumb: Even the rear has built in work lights. The only thing I don't care for is the nerf bars on the sides.:dunno:

Nerf bars are really nice smitty built ones. Really strong feeling.

That being said....had i not been looking at break stuff, and fighting a F'd boat trailer, they would have been off tonight. :D

The rear lights are worthless, gotta try and clean up the lenses, and put brighter bulbs in them.
 
here in ny state the dealers are required to pass a vehicle inspection at time of sale just the same as joe blow off the streets car would.


but .............................:whistle: most get lick n stick passed on the used car lots from small dealers. i know 1 shop here in town he wont do squat to them unless he has to after the sale . and most of them need a gravy list of repairs as he buys the crap at the auction no one wants. :doah:
 
Question 2.

Can a dealer legally put P rated tires on a 3/4 ton truck?
 
thats a funny loop hole . if the total weight per wheel position is covered by max weight per tire then thay prob legaly be fine.

would i do it . . . hell no.

did i use to yell at the guys up front selling tires about this yep sur did .
 
Hm. How do i figure that out. Divide GVWR by 4?

The tires are rated slightly less than my Load range D's on the other burb.

Edit: Tires are rated at 2601 per corner.
 
weigh front axle and rear and total . then divide each axle x2 and thats per wheel weight . and see if thats under the max per tire on sidewall info next to max psi info.

or if race car buddys weigh scale set per wheel.

but most p-metric load is just under load c ratings or extra load p-metric.

if you look around there is lots of info on weight per tire per load range on web sites of tire brands. and the diffrence will be a little eye opening for you on some weight tires but not all.

That would be a requirement of 3000 per tire. 2601 is short.

I would never buy from a dealer for this reason, they know the law, and how to skirt the law without getting caught, and you are wasting time and money and energy trying to get something out of this guy.
You bought it sight unseen, you will end up eating it.
I have bought things sight unseen, and I never think about what I got after I make the payment, because it's done and there is no return.
I even bought a commercial trailer, and with those they have to pass a min, and the tires were pretty much at the min, by the time I got to my first destination I need new tires, and the brakes were pretty much the same.

I flew down to pick it up, so I got to see it, and discuss what i thought was misrepresented before purchase.

There are plenty of issues with this truck....but the only ones i am taking up with him at this point are "minimum safety" related ones. He is being cooperative enough with the brakes, but if he tries to squirm out, I'll look into formalities.

As-Is, Where-is has its limits when you have a dealer license.
