I don't think the court could make a fair decision based on lack of knowledge. Knowledge like lower gears would have prevented this.the only place to decide who is right is a court.
Being in 4lo would have prevented this. Then he wouldn’t of have had to go full throttle to get over the obstacle. Certain expectations are to be expected at events, what he did was not one of them. She was so far away from the line of travel he had to drive over to hit her. Did his brake lights ever come on ?
