You may want to move this to the parts section. As per CA law you are responsible for a valid smog cert. "If the vehicle is over 4 years old, it is the seller's responsibility to provide proof of a current smog certification unless the vehicle registration was renewed with the California DMV within the past 90 days. Proof of smog certification is not required if the title to the vehicle is being transferred within a family.

If you do sell it without a smog certification and it doesn't pass, the seller is responsible for repairing it to the smog certification standards."

By having it in the complete vehicles section instead of the parts section you are selling it as a complete vehicle regardless of you listing it for parts. I have a friend of mine in court right now dealing with the same exact thing. He was the seller and sold a "parts truck" complete with a bad engine and now the buyer is pressing him to smog it. Even thought that was the whole reason he was selling it as he could not get it to pass smog and he told the guy that. You will probably make more money parting it out anyway. Heck there are a few things on there I would buy. I just don't want to see that happen to a fellow CK5'er. Good luck with the sale.

Tempting...

I thought all you have to do was write "as is" in the bill of sale and you can avoid all smog problems. Or at least write something about buyer is responsible for smog on bill of sale.

People do it all the time, but its not technically legal.

If it fails smog, and they wanted to take legal action against you, they probably could.

I hate doing it, but have sold a car like this. Made a full disclaimer of what the issue was, and they extensive repair was needed to smog.

In California the seller is responsible. I was hoping somebody wanted it just for parts. It is drive-able and I would get it smogged if needed.
