I'm told its my bosses x wires, x boyfriends truck who is in jail, she said i could have the truck but can i legally register it or not, how can she sell it to me when sheer doesn't own it. Its been sitting there for over 8 months. He still wants it but he preety much abandoned it. She's selling the house and is ready to call police or wrecking yard to have it removed. But i want it, legally. Thanks guys

theres some form she has to file for abandoned property. Legally, you cant touch it or modify it right now. And you wont legally own it after i believe because his title will always trump you. But, if shes worded on the title correctly, she could legally sign it and sell it to you, but that doesn't sound the case.

Lets see, he's in jail, and he still wants it. I am guessing he will try and "take it back" when he get's out, regardless of who has it. I wouldn't want to get involved in that.

Talk to the owner, should be easy to find, doesn't sound like he's going anywhere. Maybe he'll sell it cheap, legally get you the proper title and all. A few hundred bucks is better than nothing which is what he'll get if she scraps it.

Honestly.... I'd kill somebody.
If I got out of jail, and someone else had my truck....

That would be a baaaaaad day for someone else.

So... from a crazy-person's perspective.
Don't do it!

BUT,

You could give him a ring in jail,
I hear a few hundred bucks is a LOT of commesary.... (sp?)

In CA you can lien sale it and take ownership in lieu of him paying the storage bill.

Possession is 9/10ths of the law.

Chances are if it's on her property, has not moved, and she can't get rid of it, there is a law on her side. She or you should contact the DMV and spell out the specifics.

Personally, when dealing with someone who is incarcerated, I would say it might not be worth dealing with. For $500 or $1000 you can probably buy something from Craigslist that will be less headache.

ohh.. thats dirrrty. :haha:

It is dirty on a personal level. But its the only legit way for a shop to get rid of a car that has been abandoned, or for the shop to re-coup the money they may have spent on parts/labor out of their own pockets.

IIRC you have to have a licensed automotive shop or a vehicle sellers permit and address to start a lein

iv heard b4 but idk if its true, if something is on your property for 30 days its legally yours but idk if that would work with a car or truck

Thanks for the suggestions, the truck is not running been sitting for longer a few years, missing a drivers window and door handle,
doesn't run, and is more or less a pile. Its a 2wd camper special with the 60 rear. Wanted to use it as a sport truck. BUT NOT WORTH THE TROUBLE. Considering there's dozen on cl for close to. Nothing or free.

I had the same situation once, I drove passed a 85 blazer on 44inch super swampers, Dana 60 front and 14 bolt rear both with lockers,203-205 doubler 8inch lift kit, shackle reversals ect. that was down the road from my house for the last 3 years. I stoped by numerous times to ask about it since it was covered in blackberry bushes. finally I talked to the lady that lived there and she said "it was her brothers and he stored it there about 4 years prior and never came back to get it. when asked what she was going to do with it she said" I haven't heard from him in over 2 years and he lives in montana now so if you want it go ahead and take it." I didn't want it to drive it but just for parts so I wasn't worried about titles. I got it home started taking it apart and about 2 weeks later I came home and it was gone. drug right off the jackstands on to a flatbed truck. Two days after that I was coming out of the store and was approached by two rather large and menacing looking tow truck drivers who said "What possessed you to take that truck?" I told them the story of what happened and they followed me back to my house to retrieve the remainder of the parts and after all was said and done they told me that one of them was another brother of the guy who owned the blazer and that the sister had tried to get him to tow it away but for some legal reason he couldn't. Well a really long story short turns out the guy that owned it was dealing with some serious health issues and had to move back home to live with his parents while he recovered and he owed his sister money so she tried to get rid of it . I learned my lesson and if you are not talking directly to the owner than I wouldn't even touch it. Besides you do not want to feel as bad as I did after finding out the other side of the story.
