you got an attorney for a 22+ ticket?!?! i got pulled over doing 64 in a 35, went to court, plead not guilty, and got 12 mos probation out of it.

Were there roads?? Did the area appear to have regular vehicle traffic? What was his reasoning for the recless ticket? Did he say you were in an area that was closed to vehicles? You need to ask questions when you get these kinds of citations. You really need to find out answers and build a case for your defense before you go to court. There is a ton of legal info on the web. I am sure there are forums aimed at beating BS tickets. Spend your time searching for that kind of stuff. I have a buddy that has beat a couple of tickets on technical things such as the officer had a time of say 1200 hrs on the ticket and his log book showed he was at location X at 1100 hrs dong what ever and location X is an hour and a half away, now how could he have seen him commit this offense if he wasnt there? Just stupid stuff like that, they have to show you all of it. If you plea innocent supeona everything you can, officers logs, etc. You would be amazed at stupid mistakes they make. Find any loophole you can.

So they offered him driving school and nothing on his record, he took it.

Dont let them get away with this kind of crap. They can only cahrge you for what they have written you up for (unless you take a plea deal). If a judge makes a statement like that you have a good chance to appeal his descision later.
 
this happened yesterday. but ok i just got back from takin pictures and wouldnt you know!!!! 3 jeep terds dressed in ralph lauren and preppy a$$ clotheswere out there wheelin around! who goes on trails dressed like that!! anyhow should i show those pictures of the jeeps to the judge!??? or will he just think their my friends???? this happened in fort worth and primetime i hope to God your right about number 3! does anyone think i can get one of those lawyers that i dont have to pay unless i win??? as for the road that leads there its right off the highway and is a mile or so long and its gravel. theres clearly 5 or 6 different tread marks embedded in the gravel and 100% sure theres no signs posted. if there was one ide prolly steal it and burn it to back my case up. MUHAHA........but thank everyone for yalls responses and experiences it gives me a better idea of whats gana happen to me! ill let yall know what goes down

Yeah I know. The only reason he didn't fight it further is because they offered him that deal so nothing is on his record. I'm pretty sure it was private land he was caught on, and some whiney homeowner called the cops cause he was stuck there. This particular cop was a real dick about it too. He said there used to be trespassing signs but we probably tore them down, so he couldn't arrest us for trespassing. Then he called us all s*** for brains. :mad:
 
I'm going to come as an ass by posting this but cant believe no one has said anything yet... And I am not trying to come off as a prick.. I've made mistakes in the past too and have been fined for being where I shouldn't have been.. Butwe all need to make an effort to keep places open and not add fuel to the anti-wheelers fire!

First off, if the property isn't posted and isn't listed anywhere as an ORV area, you shouldn't be there unless you talk to the land owner! Just because there aren't any signs, doesn't mean you can do whatever you like! And just because other people are there, doesn't give you the right to be there too! You have to get permission before you just just wander off onto a piece of land! City owned or privatley owned it doesn't matter.

Another thing, did I read one of your posts correctly and you're running open headers? This just screams give me a ticket and draws attention to you anywhere you are. Not too mention its annoying to most people around you(not just wheelers but homeowners in the vicinity who can call the police). Not a smart move when wheeling. We get enough bad press as it is, dont fuel their fire. If you have an exhaust system, please disregard my last comment.

Now I do agree that the land shoud be posted in someway for no vehicle traffic, etc. And if there is a patrol person out in the area often, they should keep the signs up... Dont think having no sign is goign to get you out of a ticket, but at least rbing it to their attention. More than likely it is posted and someone pulled the sign and threw it off to the side.

And regarding your comments about removing the signs.. Come on... Grow up... Other people frequent these forums who aren't wheelers and are just looking for things like this to use against us.

This depends on the state. In PA all private and public property designated no tresspassing must be clearly marked every 100' by posted signs with the landowners name and contact information on it. This way should you want permission to go on the property you know who to contact. In addition I do not know about texas but in PA I have seen public roads in worse shape than private drives. How is a person to know if that turnoff is a back country road or someones driveway without signs.

Now this also requires a bit of common sense. If I see you doing doughnuts in a farmers field I'm gonna clock you in the head with an axehandle. but running a road you don't know just to see where it goes and getting fined for it...I'd fight it tooth and nail.

I say fight it and get a lawyer. When I was young I got pasted by a minivan while driving my 81 Omni on a back road. Since the guy driving the minivan was 60+ and I was 17 I got ticketed for reckless driving, speeding 91mph), and crossing the center line. First off I was following my wife, then fiance, who testified the minivan was going like a bat out of hell with it's high beans on. Second, that car had almost 200k miles on it and wouldn't do 91mph down a mineshaft. 3rd, and this was the clincher, my lawyer pointed out that the officer issuing the ticket was not a certified accident reconstruction expert therfore all his observations were rendered null and all tickets were dropped.

In short, get the lawyer, worth the money.
 
I'm not sure what your fighting! Did you think that you where unjustly ticketed for offroading in a place not set aside for wheeling?

I hate getting hassled about offroading as much as anybody but open header rigs on land that's not ORV approved is why we've got such a bad persona !

If this happened off of 360 near the Airport its hit or miss, it is illegal to be out there as some people tear down the signs. Actually I dont know of a single place in the metroplex that is legal to 4wheel other than Marhsall Creek and its not much fun.

Yea I got an attorney for 22 over. 17 over in NC is reckless driving. And I was in a school zone. And I got a CCW charge. You bet your ass I paid for an attorney, and it was worth every penny. Both my driving and criminal records are clean and my insurance wasn't affected at all (I actually got a safe driver discount not too long after my court date), and in my opinion, $600 is a small price to pay for that. :waytogo:
 
MAAAAAAAAN. i was only kiddin about burnin the signs! its not like i think im some God and can take my blazer wherever the hell i want to. i had driven by there plenty of times and seen people driving back there with four wheelers and people goin to play paintball out there and from what i heard never had any problems. and runnin open headers where i went would not be a problem to anyone because there arnt any businesses/ residents for miles and miles! the only people i annoy are my poor neighbors.... NTXk5 i wish i trusted my blazer to get that far to 360 bc ive heard great things bout those trails. are you talkin bout the ones off 360 and trinity??? gravdigr im not sure if your familiar with fort worth but there are these trails past the house of blades in fort worth but before the northwest campus of TCC off marine creek. well im off to work to make some $$$$$$ goodnight everybody.

I guess I'm just getting older and am not fond of loud exhaust anymore. Plus I feel it just draws more attention than needed...

And I figured you were kidding on the sign comment.. BUt comments liek that made in a public forum are what these anti-wheeler type will thrie on and use it out of context...

I'd call a local lawyer and see if they will give you a free consultation to see where you stand. See what route they feel you should take. At least try and get the ticket reduced if reckless drivign is a serious offense in TX.

i hear you emmet work does the same thing for me. you did make some good points though i must admit. the exhuast is just kina a temporary thing because when i got it the blaze had extremely quiet mufflers on it with headers so i just hacked it off till i can poney up the dough to get a decent soundin system. and i had no idea bout all these people again wheelin. well at least the kind that go through here lookin for things to use against us. ill be a little mroe careful later on. thanks for the advice

That will not fly in TX, first there was no accident and second it is only a moving violation.

Think you missed the point. Had it not been for the lawyer I would not have known the officer needed to be certified and in all likleyhood would have been stuck with all 3 tickets.

I see what your saying, the lawyer knew what would work when you didnt. I ment that here in TX what the lawyer used for you about the officer being certified in accident would not work here, thats all.
