Go get it! They've been running it in your name ever since you sold it...They didnt care about you and your rights... You've been libal for everything they did. I always get a bill of sale. Here in Arizona your suppost to send your registartion into the DMV when ever you sell your vehical, so your no longer have any resposability for what happens with that vehical. I know a lot of people don't but it is an AZ law.... Do what ever it take to protect yourself and your family.

Pick up your truck and hopefully it's in better shape than when you sold it!

A bill of sale does NOT need to be notarized to be legal.

You seem to fail to grasp that what he did (as the original title holder) is "illegal", by not sending the title transfer paperwork to the state. It is a STATE requirement to send that in within 5 days of transferring the vehicle. (just so this situation is avoided) By not transferring the title and selling or trading it, he may have given up ownership, but not registering that with the state does not mean he still owns it!

Since he got the bill, he is likely the last registered owner, but I don't think it would hurt one bit to head down to the local DMV office before throwing money down and make sure that the vehicle is listed as being his. If he got a letter, it should be, but it would be prudent to check with them before anything else.

They should be able to do it with the license plate, (or VIN) but if it has not been registered in 3 years, it is supposed to drop out of the state computer system.

Well shoot. Maybe I've done this backwards. I went and got the truck and paid the $356 bill and have it home now. So, now I'm going to the DMV to discuss what I can do. I'm going to try and get a hold of the parties involved to sort this out. I have my receipt for the bill, and I hope I can get my money back. If I have to, I'll even try and buy the thing back just to avoid hassles.

Well, its the same motor. Just different intake and valve covers and carb. They've also been driving it around with no rear driveline, only the front. Also, theres a socket and extension in the ignition instead of a key. But it drove home ok, just seems like the vacuum modulator line is disconnected.

No matter what happens, you need to make sure you go to the DMV and pick up a form to report that truck as sold. Before you turn it back over to whoever owns it have them fill it out and you take it directly to the DMV.

I take it when you sold it the only paperwork done was a signed title?

Right now keep the truck locked in your garage and out of sight if possible, then try to contact the "driver" to discuss it. If everything goes right you need to meet with the "driver" and the person he is buying the truck from. The driver should pay you for the towing/storage and fill out any paperwork to get the truck out of your name before getting the truck back.

The person in the middle selling the truck on payments is also doing things wrong. He should have transfered the title to the buyer and put himself on as a "Leinholder" until it was paid off. That is his only way to have a legal right to that truck since the title doesnt even have his name on it.

Well, I went down to the DMV and now the truck is assured 100% legally mine. I didn't want them to be able to transfer the old signed off title, then be able to claim the truck as theirs and not pay me the tow/storage bill. So, I applied for a new title and the other one is void.

But I'm not going to merely keep the truck, cause that wouldn't be right. I have no way to contact the parties involved directly, though I've tried to trace them down only to get dead ends.

So, the towing company has my numbers, and if they pursue the truck, the should be able to contact me, in which case we can sort things out. I'm into it $356 + $17.50 at the Licensing Dept. I should probably put a rear driveline in it and take it up to storage north of here, where it can't be found. All I ask for is my money back, I won't charge for my storage or hassles. When I'm paid back, I'll deliver the truck back to them.

Is 30 days long enough to wait to receive contact?

Sounds like you are doing the right thing. I would give them the 30 days and then I would move on with life. You should not be required to hold peoples hands and have to pay money for other peoples lazyness.

I bet somebody gets ahold of you on it though.

[/ QUOTE ] Personally I'd take it up north, and if nobody contacts with-in 90 days, then go to work on it. But I wouldn't do anything other then store it for atleast 90 days.

Keep it 90 days and then tear into it. If you have a rear driveshaft, put it in and then charge whoever comes to get it a fair price for puttin it in. Odds are if they didn't do the right paperwork and were driving it with no rear shaft, they are too dumb to even fix it.

Now my story. I had a camaro after HS that was stolen. It was found in the 'hood burnt to a crisp. The police contacted my mom(it was registered in her name) and asked her what to do with it. She asked if they had towed it yet and they said "it's still too hot to tow safely" so she called me and I went to look at it. It was still hot enogh that I couldn't keep my hand on it longer than a couple seconds when I got there. They had taken out the stereo and burnt everything else. They didn't even take the wheels and brand new tires off(they still had blue on the white letters and nipples). So I call the cops and ask if/when they will tow it. They say it will sit for at least 24 hrs due to where it was found and to let it cool off. I tell them "don't tow it, I'm going to get a trailer and will haul it off myself" to try and get some $ for it as scrap and avoid towing expenses. I was back in 30 mins with a truck and trailer and the car is gone. I call the cops and they know nothing; call the city's towing contractor, they know nothing so I say screw it.

2 months later I get a letter from the towing company. I owe $1750 for towing($250) and storage($25/day for 60 days) or I can mail them the title and call it even. So I tell em to get bent, I bought the car for $1000. And no way are they getting my title so they can sell a claen title and VIN to some a$$hole who stole another car. So I never heard from the police department or the towing company again.

A little late now but I doubt you can be held responsible for towing or storage of a vehicle even if it is in your name. I talked to a friend at a towing company about my situation. He said if they tow a vehicle cause it was abandoned or impounded and nobody claims it or they refuse to, they get a salvage title for it and auction/scrap it to recoup costs. He said police depts. pay a small fee for towing and most of the time the towing co. loses $ after towing/storage when waiting for paperwork. They have no recourse against the owner of the vehicle other than charging them for towing/storage IF they pick it up.

They told me that if it was left to auction, after 30 days, I (as the last registered owner) would still be legally responsible for any fees not paid off by the auction price, and it would be considered abondoned property and I could be found guilty of "littering".

But anyway, its sitting in my driveway here, with a rear driveline I threw in it so I can drive it up out of town to store it till someone contacts me. I grabbed the personal items out of the cab and put them all in a box for him to pick up when he's ready.

Legally, I could be a jerk and say "too bad, I have it now and you cant do anything about it". But if I get... say $400 cash back from him, he can drive it home, even with an installed rear driveline and a signed over title... and a slip turned in by me to the Dept. of Licensing to release my liability/interest.

If no one gets a hold of me by spring, I'll keep the 3/4 ton axles and the 4" lift and put 1/2 ton axles back under it, and I already have it traded off. But until then... even though it's legally mine, its not really mine in all fairness.

All the more reason to go to the cops and NOT mess with that truck. If it's beeen involved in a crime then they may come looking for you.

According to the paperwork, the police have released the truck. It was an impound only, and not needed to be held for any reason. Whatever he did to lose the truck must have been minor.

It also says that there were 120 hours from the time it was impounded till the time it would go to auction.

The only thing I'm worried about is the driver of the truck trying to get it back without me knowing. I'll be blocking it in my driveway tonight.

If you do start driving it regularly make sure you keep all paperwork involved in this matter or at least copies in the truck.

If the person who was driving it when it got impounded got a ticket and they dont go to court on the ticket then the truck could be listed as an associated hit. (Warrant) So it you were to get pulled over then they might alert the officer that this vehicle was associated with a person with a warrant and you might not like how you and your friends are treated until it gets straightened out.

this would definately happen if washington is a state where the plates go with the vehicle.

So to avoid that if you are going to drive it I would at least go and get different plates.

Well it sounds like you are in the clear.

Everyone was right though, just like you were told, if you DIDN'T go pick it up, you would ahve been liable for all the fees associated with towing and storage, which would have just piled up.

My sister did that to a guy...he gave her a car, never changed title over, she never bothered to get it running, so she just left it at her old apartment complex, and he was assessed the towing and storage bill. She's so nice. /forums/images/graemlins/smile.gif
