I have a th400 that has a broken ear on one of the side mounting holes just above the guide hole. Is this a deal breaker, or can I still use the case? Can I get away with using the other 5 mounting holes and mabye some fender washers on the hole w/ the broken ear?

I think you could. The worst that can happen is that it breaks more... I'd run it and just keep an eye on it.

If you have a stockish motor I think it would be fine.

I have had soo many trucks that came with only 4 bolts or 3 bolts on.
If you make sure the 5 bolts are tight, and the 6th put on with washers you will be just fine.

if you have the broken section it can be tig welded back on just fine by a good welder.
