Abandoned 73-75 K5 Kane Creek

I believe it should be done legally, make sure what the situation is but quickly before the truck it destroyed where it sits, while it is worth the effort....
 
Well you can go pick up the vehicle being the "Good Samaritan" however any damage caused will create a means for that person to sue you. An unfortunate thing however it's true. You may pull the thing off that land contact the owner through your method of abandoned title however you can still get sued. If he is setting a trap for someone (has happened before) the person could say you took parts off his vehicle and sold them. You say you just recovered it in this condition. He could say you took parts off the motor and damaged his front and rear end and you are responsible. Same things a tow company would go through however with them they have this wonderful thing called a bond. This helps protect them from direct liability.

It's your fuel/time so it's completely up to you however think about this as well. I break down in moab and live in Arizona. I take wheels/tires/few important items off vehicle so nobody can drive it. It takes me a few days to get back there with some proper help to recover vehicle. I get there and it's gone after spending days trying to get the parts I needed together and help. Now I'm frantic about losing my vehicle/time/money and still have nothing.

I understand you're trying to be helpful possibly to someone however contact PD and let them figure things out as well. At the very least call them up and say "Hey I'm going to retrieve a vehicle I believe to be abandoned. Can you get the owner of vehicle and let him know I've recovered it for him?" And see what they say. If they give a straight go ahead then fine just make sure it's documented. If their is no record on file it didn't happen according to courts.

I hate looking at it this way but with people stupid enough to spill coffee on themselves and winning a lawsuit Ya never know.

The proper thing to do is to call the appropriate authorities, and let them deal with it.
If its not yours, and you take it, then you are stealing in my book.
 
i used to drive tow trucks, and can tell ya that the only reason we were allowed to remove a vehicle from the roadside, was because we had law enforcement authorization to remove a potential hazard,,,

almost pretty certain that if ANYBODY messes with a vehicle ANYWHERE, without FIRST going through the proper procedures like DMV or law enforcement, NOTHING can be touched on the vehicle without being considered vandalism or theft.

even trying to be a "good samaritan" and getting it out for him is still considered theft unless you have the authorization from some government official.

just some thoughts to ponder.

we do have problems here in Arizona too, where people break down on trails, and the owner tryie to go back that day for help, ends up being over night, goes back and stuff was tampered with, stolen and whatnot,,, i know, had a friend lose his truck due to these vultures.
 
So i guess no good news so far?

As to taking parts off it, trying to remove it, etc. If it were abandoned on my property, i assume i would have the legal right to move it if i deemed it necessary and i did not put it there or give permission for it being there, am i correct? Granted, i would have no legal right to sell any parts, or modify the vehicle in anyway, for its not my vehicle and not deemed abandoned, even though it was trespassing.

But all in all, ITS NOT THEIR LAND! I feel sorry for the guy, if his trucks stolen, hes worried stick. If its broke down, hes probably trying to get the money to get the parts he needs to get it out. I think i would camp with my rig and stay with it till i could find a way to get it out, ive never been to moab, or a serious off roader (just getting into 4x4s), but i do feel bad for the guy.

Anybuddy have any good news about this rig? owner contacted? truck removed, etc? Kinda sucks not being able to see the pictures. Hopefully be a subscriber next paycheck.
 
My opinion:
Contact the local authorities. If it was stolen, then the owner, authorities, insurance adjuster, etc. know where to look thanks to you.
Take a couple pics of other Blazers on the rocks so they can do a line-up just for gits and shiggles.

If the owner does not want the vehicle, then go through the proper steps, and make sure your steps are documented. Exchange at least one (1) dollar for the vehicle. Get a bill of sale. Get the title correctly transferred. Get the vehicle ASAP. If the trailkeepers give you crap, you have documentation that you JUST purchased the vehicle, and that you intend to remove the vehicle from their property. You are doing them a favor. You should have documented photographs of the vehicle when it was in the rocks before you were the owner. That way they can't fine you, file a judgement, etc.

I don't see the problem with acquiring (not "taking") this vehicle through the proper steps. It does the owner a favor, as well as the trail owner, and the authorities. It's the same as buying a junk truck from a guy's pasture.
 
so has anybody called the authorities ?? Or is everybody too busy washing the sand out of there mangina's from all the dirt being slung in this thread??


If you can contact the owner to help him retrieve the vehicle . If not Then I say drag that pile to the side of the highway so then its Highway patrols problem. and the greenies cant use it as an excuse to shut us down.


I'm not real sure it was such a good idea to go posting pics of it either I'd bet a case of adult beverage that in a few months that picture ( or one like it) winds up on a Bunny Humper web site for all the sandal wearing subaru driving hippies to see.

Id like to hear some good news about this truck? any updates? more vandalism? Hopefully the owner got her home. I love the 73-75s.
