extremely PISSED!!

So how as the birage calling going. I would deifnitely pursue them in a criminal situation Does the company even know what criminal laws they have broken? You should call and tell them.
 
I just called and was trasfered from the receptionest to dispatch,, the guy there told me the guy to talk to is Joe.
He woudn't give me a last name and said "Joe" wouldn't be back until tomorrow morning at 5:30 am.

Thanks for your concern Steve. But I got to tell yah. Weirdest thing. My insurance comany called me and I gave him the info. He said all he could do was take the liscense plate # I gave him and run it through the MVA (DMV) and get their insurance company for me. Then I have to pursue it. I thought great. So when he called me back, he said the DMV has no records on that tag number what so ever. He told me to drive back there and write down as many tag numbers that I can and give it to him b/c the other vehicles would be covered under the same insurance co. So I drove back there and not one of them were out there. They all must be off today. This is just all to wierd.

Goose is right! I work for a Commercial Insurance firm & see this kind of crap from time to time. Find out who their insurance carrier is. When you speak with a Claim Handler, tell them "I've got "Specials" that need to be met here." What tha sez is that you "lost $$$ from work, had to get a baby sitter" etc., and Specials is a multiple of your actual physical damages (windshield etc.). I'd say your looking at @ least 4-8X on Specials--hehe LOL.

Hey Boss, I don't know about your state. In Colorado you can do a counter report. It is a report filled out by one or both of the parties involved. you go to a police station that has jurisdiction over the area and fill it out. Put in as much info on other party as you can. See if that organization (police) has a motor carrier unit or tuck enforcement and explain the circumstances. They may want to do an on site inspection. You can also contact the interstate commerce commission or public utilities commision. one of these would regulate this company. If they do work in more than one state the feds may come out and inspect them. you think the IRS is tough try them. Letter from an attorney works well or small claims court. If you get thier insurance info contact that company and advise them of the driver leaving the scene and suggest that they think about not renewing policy.

Another good deal is to contact whomever they are working for. the company they are doing construction or what ever for and advise them. Just a couple ideas I have used. Check on laws about tarping loads and spilling load on highway. If you have the company name that should be enough. Good luck.
 
I might be making progress. I finally remembered a different tag number, they are numerical, and called that in. I got their insurance info and everything so I filed a claim. I should be hearing from them within 24hours. Hope so. Corey, to answer your question, I don't know. I'm not even sure myself. Everytime I call, I just complain about how they are not being safe how careless they are with their loads. I also tell them that they'll be hearing from me again. Hope all this is worth it. I thank you all again.

Glad to hear you are making some progress.
That truck must have been on a paid for rute. So now when they get a claim filed, I guess those driving-schedules will be brought out. They will have a ISO 2000 documenting responsibility that all companies have to follow.

This could turn out pretty sweet if you get those "extras" in your claim to.

I am sorry that I am late responding to this, but I cannot believe that you are being jacked around like this. What if you had the top completely off? That wire would've taken someone's head off. I can't believe the attitude of some people. What kind of professional lets wire whip around like that in the first place? Sign me up for the e-mail hell program. I have figured out a nifty way to get them 300 messages a day at least, and they will never know it's you (or me, in this case)! I also thiink that you should sue them for reckless endangerment. I am also available to go down to their offices and starting with the first guy we see kicking the <deleted> out of each one until one admits to it. I have some violent friends that would appreciate the outlet. Let me know.

Hey man, thanks for asking. Unfortunately, this situation didn't pan out for me. I tried everything, but in the end the result was that there were 3 different dump truck companies up there (and they all look the same according to them) so there is no way that they can determine which company did it, so now I'm still stuck with a severely cracked windshield (that I have to get fixed soon before it really gets cold and crackes everywhere). I have other problems right now to take care of though. My truck just shorted a wire and fried everything. Sucks. Oh well. Thanks for asking again.

That is total B.S. I agree with everyone. Don't give up, continue to call and write until you get some resolution. I like the e-mail idea too. They need to be held accountable for thier recklessness.

That really sucks bud. If it helps any, I'm the president of a classic car club in NC. If your insurance company asks you where you were going when it happened, tell them that you were going to a club meeting. Tell them to contact me at [email protected] and I'll tell them that you are telling the truth. Maybe it'll work and you will get your truck fixed.

Here's what I would do if I were you.
Definitely go to your local BBB and fill out a form. some companies will withdaw their business from another company if there is a negative BBB report left unsettled. It could only help you. I've actually done this before and it did work.
Get a smooth-talking friend to call the company as your legal representation and advise them if restitution is not made by a certain date (usually 2 weeks is suffice), then legal action will be made. This is not lying as long as your frind says he is your "Legal representative" and not a lawyer. You dont have to be a lawyer to represnet a party.
Also, when they call, find out the name of the person they talk to and mail a certified letter to them with the same threat. This will definitely get you something.

If all this fails, and the law won't help you, I say time to get even ............

Well, I just E-mailed them. I used my best professional jargon. I didn't use any cussing or threats. I let them know that "we", all over the country are behind him and that we are going report this to the BBB and MD DOT. And I let them know that this was a Notice of Intent.
P.S. Steve if you are reading this. I in no way used K5's name. However, in the future I think, if that someone is to use the name in this battle it should be you and only you. This is a note out to the rest of you as well. This site belongs to him. So that previlage should remain his. I know how we can get carried away in the heat of the battle.

I want to thank everyone for your care and concern. Thanks ftn96 for emailing them and also Stoop for the suggestion. Although I tried this route a while ago (the emailing and threat to take to court etc). But to no success. I know what you mean by getting even. I thought about trying to plot something, but then decided with better judgement. This has happened a while ago, so I think its a lost cause. Thank you though. You figure a windshield install shouldn't run no more than $150 and my mirror I replaced a while back (still got some black marks on my truck from the big wire though). I know, its a $150 I could've spent on beefing up the truck, but nothing I can do about it now. Anyways, yeah, I agree, If someone was on a motorcycle or something while that dump truck whipped around the corner with that bigass wire hanging out, I think that would've taken their life!!! Man, the danger just driving to work!! Yall take care.
