Urgent truck missing

Holy crap this would be my worst nightmare:eek1:, I would rather be running away from Freddy.

And that guy who has it needs his teeth kicked in. He's probably even selling it for less than what its worth.

It may not bring your truck back, but you can go after the storage buidings past and present owner through civil court. File an Action to Recover Personal Property(Tennessee law). You should have a similar law there.

I know I am kicking myself in the ass for trying to do the right thing and have the law invloved.

as a Update though I am just waiting for the guy to be served, the sheriff was not able to serve him so I have to hire a serving agency.

I have a court date set for next week, but a Buddie that lives in the are said my truck is no longer where it was. I sure hope this guy is not dumb enough to do something with it after the warning from the cops and knowing hes being sued ( he has had a meeting with my lawyer already)
 
This doesn't help but heres a fun story for you about me.

Once upon a time i had a 89 Toyota Camry. Naturally, it got stolen. Long story short, I hadnt put the title in my name so i wasnt allowed to report it stolen. About a week later i saw the car. I still had the keys to it. So i jumped in it and drove it home. Forged a couple documents and put the car into my name. Done deal. Then, the next time it got stolen i was able to recover it.
 
If does destroy or conveys it after being served he could be looking at criminal charges.
 
Update:

So I had my 1st court date last week and things went pretty well, the judge told the guy he should give my stuff back. The guy said no and the judge set a hearing for this Thursday to determine possession.
Well fast forward to today, the guy called my lawyer and told him he did not want to fight the lawsuit, this means the judge will issue a default judgment in my favor and I can get my stuff back this thursday :woot:

So I had my 1st court date last week and things went pretty well, the judge told the guy he should give my stuff back. The guy said no and the judge set a hearing for this Thursday to determine possession.
Well fast forward to today, the guy called my lawyer and told him he did not want to fight the lawsuit, this means the judge will issue a default judgment in my favor and I can get my stuff back this thursday :woot:

Good to hear!

Did he give a reason to the judge? I mean for saying he didn't want to give it back?

Just curious to find out what supposed claim he thought he had on the stuff.

Really hope he doesn't dump sand or something in the tank or in the engine.

Glad you got your stuff back! Glad you went about it the right way!

Id ask your lawyer if there is any paperwork he can put together for the other guy to sign, incase he did try to f**c with your truck.
