warning about the Throttle Shop/ebay member xtreme-fi

Just wanted to post a warning to everyone about how these guys do business. I recently sold a 86 TPI intake on eBay to eBay member xtreme-fi. Money received and package delivered, no problem right? Well a day and a half after the package was delivered I get an email stating that the throttle body was broken in shipping, there is a huge hole in the side of the box and the only packing material was one small piece of thin bubble wrap, what am I going to do about it. I informed them that the description of packing is not at all how I sent it (everything was wrapped in a double layer of large bubble wrap with all the voids in the box stuffed with the same) and that he should file a claim with UPS for shipping damage. He refused to even contact UPS and instead filed a claim with eBay saying the item he received was not as described. EBay instructed him to return the intake to me and he would get a refund as soon as he submitted a tracking number. He created a shipping label to give a tracking number to eBay. At this point I disputed the claim with eBay because the item was shipped exactly as described and securely packed, and I had already informed the him that if it was damaged in shipping he needed to contact UPS and file a claim but he refused to do so. A little research turned up that the eBay member is actually a business in Austin, Tx called the Throttle Shop and they have a widespread history of complaints of cheating people. When I informed eBay of this they agreed with me that this should have been a shipping claim with UPS but because of the shops poor reputation they wanted to see what was actually shipped back to me. It took them six days from the time they created the shipping label to drop it off at a UPS store (why not just have a driver pick it up?) And then only after I complained to eBay about the time period. I got the package last night. Shipped in the same box I sent originally but there is no hole as described. Open the box to find the parts just thrown in and a small piece of thin bubble wrap sitting on top. Pull all the parts out and what do you know they aren't what I sent! The runners are the same as is the plenum, however the throttle body I sent was removed and a completely different one bolted in place that is broken, and the coolant passage on the bottom is hevily corroded and only hanging on by one broken screw. The manifold I got back is for a 90-92 and there are no fuel rails or injectors even in the box. I sent the intake with the rails and injectors still bolted to the base. So not only did they lie about the condition of the parts and the shipping box to me and eBay, they didn't even send me back the parts I sent, instead swapping them with something else and keeping the fuel rails and injectors completely.
 
Time to get a lawyer and the BBB involved along with your state attorney general.
 
Haven't heard back from eBay rep I've been speaking with since I emailed last night that the parts have been swapped. They have already told me that while they have a hold on the funds through my paypal, it is only temporary until I receive the package back and that I won't be out the money. Their main concern is whether or not I received back what I sent. If not then they will retract the refund to the buyer and proceed from there. As long as I'm not out the money I can live with that, at least I still have some parts that I can try to resell. The situation just really pissed me off that eBay allowed them to go through with this claim when it was bogus to start with.
 
No worries on the pics. I have pics on the auction listing plus many others showing the condition of what I was selling. Also had my girlfriend present when I packed and shipped the parts and when I opened what was returned. Even her first observation was that "the broken thingy doesn't look the same as the one you sent. And this piece (the base) seems to be missing something."
 
I'd raise h3ll untill I got my money, you did your half of the deal so you should get the money. They have no proof of damage.

The hole thing seemed fishy to start with. I do classic car restoration,I ship and receive parts on a daily basis. When a package comes in it is my standard procedure to open and inspect it infront of the driver of there is any visible damage. If the parts are damaged I have the driver notate the damage on the delivery record and file a claim. This package was shipped to the Throttle Shop address, why would anyone, especially a business receive a damaged package and refuse to open it in front of the driver and file a claim. This guy claimed in his email to me a day and a half after receiving the package, that the box had a huge hole in the side that the plenum had come through. Yet he then turned around and sent it in the same box back to me. No hole as described. I know its the same box because I mark all the packages I send with an identifying mark. As I told the ebay rep if I can send a glass fuel bowl for a carb from Texas to Alaska and it arrive intact, there should be no problem sending an aluminum intake across the state. The way I packed it there is no way the damage could have occurred without major damage to the box.
 
Thanks for the heads up. People will always figure out a way to screw somebody else. Hopfully you come out ahead.
 
EBay found in my favor and I'm not out any money. But when I contacted the buyer to let him know that I wasn't pleased with his theft and his obvious thinking that I'm too stupid to notice, the idiot actually offered to buy the intake base from me. What a douchebag! Anyway if you are members of other forums please pass on the message to stay away from these crooks!
 
i used to make good money on ebay. got tired of the deadbeats filing bogus claims, then on top of the outrageous ebay and paypal fees made it not even worth the time to sell on there anymore. ive much better luck with craigslist and swap meets.
 
do you have a street address? Google street view them sunsabitches. If I was closer, I'd have some non-damaging fun. :)

Yep, exactly how I feel about eVilbay now.

Listing fee, percentage fee of sale, and Pay Pal fee all add up to worthless sale of your item.

I do like buying stuff off there though but don't like selling.

Anytime I ship something I snap a photo of the item in the box.

I've been on the otherside and purchased things that weren't as described when I recieved them. So there is scamming going on on both sides. You have to understand ebay's position too. So all you can do is document everything the best you can.
