Well I talked to my bank, and they said because they have that legal BS contract when you place the order, that at best we will probably only win the 5% back, and it will cost me $25 to proceed since ballistic stab are contesting it, not even worth it. So I guess I am back to calling f'ing ballistic stab and seeing what I can do. Man I am tired of dealing with them, they frustrate me every time I call them.

You might read the contract closely. Because they failed on there end in not shipping a part. I can understand if they shipped and then you wanted to return the part. But if they haven't even shipped then they breached their own contract first which makes it null and void. For that amount of money I would take it to small claims even you would win their regardless of the CC decision.

I would dispute the full charges with the bank and point out the timeline involved. Make sure they understand you're not returning a part, you have never recieved a part. So it not a dispute about returning a part its a dispute about being charged and never recieving a product.
